Forward Looking Statement

Namibia recognizes the right to privacy as a fundamental human right under Article 13 of the Namibian Constitution. This guarantees all individuals the right to privacy in their homes and communications.

 

However, this right may be limited as required by law in specific circumstances, such as in the interest of:

  • National security and public safety;

  • The nation’s economy;

  • Health and morals;

  • Protection against disorder and crime;

  • Safeguarding the rights and freedoms of others.

While the Namibian Constitution protects privacy, the country does not yet have comprehensive data privacy legislation. Nevertheless, sector-specific laws exist to protect client information, particularly in areas like the legal and banking sectors.

The Namibian Government has proposed the Draft Data Protection Bill, 2021, which aims to:

  • Establish a Data Protection Supervisory Authority with defined powers, duties, and functions;

  • Define the responsibilities of data controllers and processors;

  • Regulate the processing of personal information to protect individuals' rights and freedoms, particularly the right to privacy;

  • Provide individuals with rights concerning the processing of their personal information;

  • Set out restrictions and exceptions under the provisions of the Act;

  • Establish codes of conduct for data controllers and processors.
